Construction industry: What is the Safety Plan Replacement

In relation to the document "Risk assessment in building construction" - a manual that comes from the synergy between the Territorial Joint Committee for the Prevention of Accidents, Personal Care and Work Environment and the Province of Turin (Torino CPT) and l ' INAIL Piedmont - in a previous article have been given some indication of the Operational Safety Plan (POS), a document that the employer shall in accordance with Legislative Decree 81/2008.

The manual, however, devotes a chapter to a different level of security: Security Plan Replacement (PSS). As for the POS, also in this case the manual proposes a model of the plan and provide guidance drawn from the current legislation.

Recall that the PSS is a plan that is prepared by the contractor or concessionaire for each site where you make the machining plan and it is considerable as replacement of PSC (Safety Plan and Coordination), when this is not expected.

It is prepared within thirty days from the award of the work, and before the delivery of the same and / or the beginning of the works (Article 131 of Legislative Decree 163/2006 amended).

In particular, the model of the Safety Plan Replacement (PSS) proposed by the manual takes into account the following indications of Legislative Decree no. 81/2008:

- "Annex XV, section 1.1.1., Letter i) means for PSS: the security plan replacement of the safety plan and coordination, referred to in Article 131, paragraph 2, letter b) of Legislative Decree no.

163/2006 and subsequent amendments;

- Annex XV, section 1.1.1., Letter l) means for POS: the operational safety plan referred to in Article 89, letter h, and Article 131, paragraph 2, letter c) of Legislative Decree . 163/2006 and subsequent amendments;;

- Annex XV, Section 3.1.1.: PSS, prepared by the contractor or concessionaire, contains the same elements of the PSC referred to in point 2.1.2., Excluding the estimated cost of safety;

- Article 96, paragraph 1: employers by the service providers and contracting companies, even in the event that the site operates a unique business, family or even with less than ten employees [...] g) prepare the plan security operations referred to in Article 89, paragraph 1, letter h). [...] ".

 

So the model proposed plan is twofold:

- "In the case of public procurement, is the Replacement Safety Plan in accordance with Legislative Decree no. 163/2006, Art. 131, paragraph 2, letter b), supplemented with elements of the Operational Safety Plan in accordance with section 3.2.2. Annex XV of Legislative Decree no. 81/2008;

- In the case of a private contract, is the Operational Safety Plan, as provided for by Legislative Decree no. 81/2008, Art. 96, paragraph 1, letter g), in the absence of the Safety Plan and Coordination ".

In the model the "contents required for the PSC that have no relevance to the situations that lead to the preparation of the PSS (presence of a single undertaking, and thus the absence of sub-contracting firms) were not considered, other content, required in several places Annex XV of Legislative Decree no. 81/2008, have been grouped together because they are considered conceptually similar. "

 

The manual for the correct use of the model, recalls that "this security plan must consider all risks, including those that are the responsibility of the PSC, so that the full assessment, in accordance with paragraph 3.1.1 and Annex XV of 'Article 89 letter h) of Legislative Decree no. 81/2008. "

Also stresses that "the conditions that determine the realization of the Safety Plan Replacement (presence in the yard of a single undertaking which is entrusted all the work, that make the whole work) allow some simplifications with respect to the minimum contents of the PSC."

For example, in relation to the following aspects:

- "The presence of a single undertaking involves the assessment of all risks and all foreseeable situations for the execution of works to be only one person (the employer of the same);

- Requirements regarding the minimum contents of the PSC (which is the reference point 3.1.1. Annex XV of Legislative Decree no. 81/2008 on the contents of PSS) provide, to the letter h) of Section 2.1.2, the ability to activate the service of emergency management of common type, in this case (preparation of PSS) can not be such an option as there are more businesses. The company organizes the service of emergency management which may refer any self-employed sub-custodial;

- The possibility of interference between the processes are solely those 'internal' enterprise editor of PSS, ie those between the teams of employees of such enterprises, and between these and any sub foster self-employed operating in the pipeline: the company must provide to eliminate or minimize the risks of such interference. "

It is necessary to revise the plan "whenever significant changes are made to the work situation assumed, especially if connected with the health and safety of workers (eg, introduction of new equipment and / or technologies and changes in the organization of work)" .

 

To facilitate the verification of compliance with the minimum content, established by law, in the form attached to this manual is a comparison chart that lets you find the same all the elements required for the PSS and the POS.

The manual also includes an appendix containing the bibliographic reference (SBR) concerning the minimum content required by Annex XV of the Legislative Decree no. 81/2008.
